Ethnic Gourmet, a frozen foods brand belonging to Hain Celestial, is closing its Framingham, MA plant without giving workers the required 60 days notice and severance pay under the federal WARN Act! The 70 workers, immigrants from Central America, Brazil and Asia, have worked with Ethnic Gourmet for as long as 11 years.

Ethnic Gourmet has a long history of ABUSE, including:

 Withholding paychecks & not paying workers their full wages
 Retaliation against worker organizing, including threats to call police
 Threats to fire workers immediately, including for using the bathroom!
 Denying workers compensation to those injured at the plant
 For years, the company has maintained a legal fiction to insulate itself from its obligations to the workers: it pays 85% of the workforce through two labor contractors that don’t hire, supervise, or fire, but only issue the paychecks.
 Now Hain Celestial is closing down the Framingham plant to open a larger factory in Pennsylvania, without any formal notice or compensation!

Workers have submitted a petition requesting a fair severance of $4,800 each, and an end to retaliation and intimidation. SUPPORT THEM!

WHAT CAN YOU DO?

 Tell the store manager that Ethnic Gourmet is abusing worker rights and that Whole Foods has an ethical responsibility to demand improved rights for the workers of the products that this store purchases.

 Do not purchase Hain Celestial products!

“I am alarmed by Ethnic Gourmet’s illegal activities of intimidating workers by asking for their papers in retaliation for organizing, and threatening to fire them for bathroom breaks. This is outrageous behavior for a company that claims to be socially responsible. It appears workers are being threatened with termination for clearly pretextual and illegal reasons in anticipation of an upcoming move of operations to Pennsylvania. I demand an end to such intimidation, and
recent abuses like late or inaccurate pay checks. Hain Celestial should comply with the WARN Act and owes workers compensation for its closing.

“Furthermore, I demand that Ethnic Gourmet negotiate with the workers at once and cease any retaliation. I support the demands in the workers’ petition for a fair severance. Surely the immigrants who produce the foods Ethnic Gourmet profits from deserve fair treatment and recognition for their contributions to your company’s success. I await your response and will spread the word to my community, colleagues, and friends.”
